Asbestos Legal Matters

After a long fight, asbestos legal measures resulted in the 1989 partial ban on the production of, processing, or distribution of the majority of asbestos-containing products. The ban is still in effect.

The final TSCA risk assessment for chrysotile identified unjustifiable health risks in all current uses of the chemical. The rule of April 2019 prohibits asbestos-containing products in the process of returning to the market.

Legislation

Asbestos law is regulated at the federal and state levels in the United States. The US uses asbestos in a variety of products even though many industrialized countries have banned it. The federal government regulates the way it is used in these different products, and the law regulates asbestos litigation and abatement. State asbestos laws can vary from state to state even though federal laws are generally uniform. They typically restrict claims made by those who have suffered from exposure to asbestos.

Asbestos is a naturally occurring mineral. It is mined by open-pit methods. It consists of fibrous fibers. These strands then are processed and mixed with an adhesive such as cement to create an asbestos-containing substance, also known as ACM. These ACMs are utilized in a variety of applications, such as floor tiles, shingles, roofing and clutch facings. Asbestos is not only used in construction materials, but also in other products, such as batteries, fireproof clothing, and gaskets.

The Environmental Protection Agency (EPA), however, has strict regulations on how asbestos can be used in schools and in homes. The EPA requires that schools examine their facilities, and come up with plans to identify asbestos-containing materials. The EPA also requires that individuals who work with asbestos are certified and accredited.

The EPA's Asbestos Ban Phase-Out Rule of 1989 was designed to ban the manufacture, importation processing, distribution, asbestos litigation and manufacturing of asbestos-related products in the US. However, it was rescinded in 1991. Additionally the EPA has recently begun examining chemicals that could be harmful and has added asbestos to its list.

The EPA has strict guidelines for how asbestos should be treated. However it is important to note that asbestos is still present in many buildings. This means that people could be exposed to asbestos. It is important to check the condition of all asbestos-containing products. A licensed asbestos removal contractor must be used for any project that might disturb asbestos-containing material. The regulations oblige the contractor to notify the authorities that enforce the law of any asbestos-related work and provide a risk analysis for every asbestos removal project. They also have to set up an area for decontamination and provide workers with protective clothing.

A certified inspector should inspect the area after the work has been completed to make sure that no asbestos fibres have escape. The inspector must also confirm that the sealant is "locking down" any asbestos. A sample of air should be taken after the inspection and, if the sample shows a higher concentration of asbestos than is required, the area needs to be cleaned.

The disposal and transport of asbestos is controlled by the state of New Jersey and is monitored by the Department of Environmental Protection (DEP). Before starting work, any company that plans to dispose of asbestos-containing waste has to get a permit through New Jersey's Department of Environmental Protection. Asbestos is present in floor tiles and roofing shingles as well as cement, exterior siding and automobile brakes. These products may release fibers when the ACM is disturbed or removed. Inhalation risk is a concern because the fibers are too small to be visible to the naked eye. Non-friable ACM such as encapsulated flooring and drywall are unable to release fibers.

In order to perform abatement work on a building, licensed contractors must get a permit from the Iowa Division of Labor. The contractor must also notify Iowa OSHA and the Department of Natural Resources. The annual and initial notifications must be paid an amount. Those who plan to work in schools are also required to supply the EPA abatement programs, as well as training for their employees. New Jersey requires that all abatement contractors are licensed from the Department of Labor and Workplace Development and that their employees are issued supervisor or worker permits.

Litigation

In the latter part of the 1970s and early 1980s, asbestos cases flooded state and federal courts. The majority of these claims were made by workers who suffered respiratory ailments as a result of asbestos exposure. Many of these illnesses have been identified as mesothelioma, along with other cancers. These cases have prompted several states to pass laws to limit the number of asbestos lawsuits that can be filed in their courts.
